Building / Zoning

6
  • A building permit must be obtained before you construct, enlarge, alter, move, replace, repair, improve, convert, demolish or change the occupancy of a building or structure.

    Building / Zoning
  • Building permit applications are reviewed for code compliance in the order that they are received. Once a complete application has been submitted it could take between four to six weeks for approval. The review time may be longer during the busy season (summer) or shorter during the slow season (winter).  Exceptions may be made for emergency repairs and demolitions.

    Building / Zoning
  • The Building and Zoning Department can accept cash, check, money order and credit card payments.   Credit card payments will be assesed a 2.45% service charge automatically by the vendor.  Cash payments should be submitted in person at the Building Department.  When a payment is submitted with a check and the bank denies the transaction for any reason, subsequent payment attempts may not be in the form of another check.

    Building / Zoning
  • All fences require the issuance of a Building Permit. The cost of the permit is based on the length of the fence. We strongly recommend that a survey is used to determine the location of property lines before installing a fence. If a fence is proposed to be installed over a utility easement a permit will not be issued without permission from the affected agency to encroach into the easement. The Zoning Code as it relates to the installation of a fence can be viewed in Section 280-27.

    Building / Zoning
  • All sheds do require a permit regardless of the size or if the shed is installed on a foundation. To issue the permit, the inspector must be provided with the length, width, and height of the shed as well as the proposed location for the structure. Setbacks for sheds are based on the size of the building. Sheds are only permitted in rear yards. The cost of the permit will be based on the size of the shed.

    Building / Zoning
  • All permanent signs, including panel replacements that are not identical to the previous design, require a sign permit. Temporary banners also require a sign permit. The following types of temporary signs do not require a sign permit: sandwich boards, political candidate signs, and real estate for sale signs.

Tax Receiver

5
  • Tax bills can be viewed and printed on the TaxLookup website.

Taxes can be paid on the Online Payments page (third-party vendor fees apply).

Tax office staff can mail, fax, or email the information to you. Just call 518-356-1980.

    Tax Receiver
  • Yes, the failure to mail a statement or the failure of a property owner to receive a statement will not affect the validity of the taxes or interest prescribed by law (New York State Real Property Tax Law Section 922.) It is the responsibility of the property owner to know when taxes are due and payable. In addition, neither the Receiver of Taxes nor any other official has legal authority to waive statutory interest charges. Interest charges are fixed by the Real Property Tax Law.

    Tax Receiver
  • New York State Real Property Tax Law Section 925, provides as follows: "Payment of taxes by mail, when enclosed in a postpaid wrapper (envelope) properly addressed to the appropriate collecting officer and deposited in a post office or official depository under the exclusive care and custody of the United States Post Office shall, upon deliver, be deemed to have been made to such officer on the date of the United States Postmark on such wrapper. The provisions of this section shall not apply in the case of postmarks not made by the United States Post Office. A postage meter postmark is not a postmark made by the United States Post Office and, therefore, is not within the provisions of Real Property Tax Law Section 925. Payments cannot be deemed timely because of a postage meter postmark date on an envelope containing a tax payment (Op. New York State Comptroller 69-170).

If taxes are not received until after the due date, they are not paid until after the due date unless they fall squarely within the provisions of Section 925 of the Real Property Tax Law, and the interest must be added and collected. No Town official or employee can waive the interest (Op. New York State Comptroller 68-626.)

    Tax Receiver
  • In general, taxes cannot be made in installments. This is an option that would have to be adopted first by Albany County, and then by the Town of Guilderland and School Districts. If it were to be adopted by the school districts, all four school districts within the Town would have to adopt it. However, Senior Citizens who currently have a Senior Citizen's Exemption, Section 467 of the Real Property Tax Law, (not to be confused with the STAR Exemption), can make installment payments on the General Property Tax bill in January. It has to be made in two equal installments, the first not later than February 1, and, provided that the first installment has been paid, the second, with interest as determined pursuant to Section 924-a, shall be paid prior to April 1. Again, this is the only type of installment payment that can be made. It applies only to residents who currently have a Senior Citizen (Aged) Exemption and only on the January General Tax bill.

    Tax Receiver
  • Collection authority cannot begin prior to the date of the warrant. The warrant constitutes the authority for the collecting officer to receive tax payments. Therefore, the warrant must be regarded as the instrument, which empowers the collecting officer to begin the collection. The Albany County Department of Finance has dated the annual Property Tax Warrant on the last business day of December. Therefore, those wishing to pay the January bill for a previous year's tax credit may do so by contacting the Guilderland Tax Office.

  • The NY State Vehicle and Traffic Law defines the permanent disabilities that qualify. If you have a permanent disability that allows, you can get vehicle plates for reserved parking from the DMV or a parking permit from your local government. It is illegal to park in a parking space reserved for persons with disabilities if you do not have the correct vehicle plates or parking permits. You can use the vehicle plates or parking permit in New York State and most other states.

According to the law, the information must describe the disabling condition and verify that the disability qualifies. • New York State has implemented the pistol license recertification portion of the New York State Safe Act. As of January 1, 2017, residents of New York State possessing a handgun license will now have to recertify their handguns every five years as per New York State Penal Law 400 subsection 10(b). A licensee is required to confirm certain information such as your name, the current address of your residence, your date of birth, and a list of all pistols and revolvers you currently possess. This also includes the make, model, caliber, and serial numbers of each pistol/revolver. Licensees who have a pistol license issued before January 15, 2013 must recertify their license before January 31, 2018. Failure to do so will result in a revocation of their license.

There are two options available for recertification:

All facets of this recertification are being handled by the New York State Police, local law enforcement and county agencies have no involvement. The New York State Police will be reviewing all recertifications and conducting audits accordingly. I was advised that pistol licenses may be reviewed as a result of these recertifications. There are no fees associated with this recertification. Any questions regarding the New York State Safe Act can be answered by calling 855-LAW-GUNS (855-529-4867).
